Terms & Conditions
These Terms and Conditions ("Terms") govern your use of the Evergrain Photobooth website and the services we provide. By accessing our website, submitting an inquiry, or entering into a booking agreement with Evergrain Photobooth ("we," "us," "our"), you ("Client," "you") agree to be bound by these Terms in full. If you do not agree, please do not use our services.
1. Acceptance of Terms
By using this website, requesting a quote, or signing a service contract with Evergrain Photobooth, you acknowledge that you have read, understood, and agreed to these Terms. These Terms operate alongside the specific service agreement signed at the time of booking; in the event of conflict, the signed service agreement controls.
2. Services Provided
Evergrain Photobooth provides luxury photobooth rental services for private and commercial events, including but not limited to: weddings, corporate functions, brand activations, birthday celebrations, holiday parties, galas, and non-profit fundraisers. Services include the photobooth equipment, on-site attendant, lighting, backdrop, printing, and a post-event digital gallery, as defined in the specific package selected and contracted by the Client.
Additional services ("Add-Ons") may be selected at booking or added later, subject to availability. All services are subject to the descriptions provided on this website and in the executed service contract.
3. Booking, Deposit & Payment
3.1 Reservation
A booking is considered confirmed only upon (a) execution of a written service contract, and (b) payment of a non-refundable retainer equal to thirty percent (30%) of the total package price. No date is held without both.
3.2 Final Payment
The remaining balance is due in full no later than fourteen (14) days prior to the event date. Failure to remit final payment by the due date may result in cancellation of services, in which case the retainer is forfeited and no further refund is owed.
3.3 Accepted Payment Methods
We accept credit card, ACH bank transfer, and check. Credit card payments may be subject to a processing surcharge.
4. Cancellation & Rescheduling
4.1 Cancellation by Client
- Cancellations more than sixty (60) days before the event: retainer is forfeited; no further amounts owed.
- Cancellations between thirty (30) and sixty (60) days before the event: 50% of total package price is due.
- Cancellations within thirty (30) days of the event: 100% of total package price is due.
4.2 Rescheduling
One (1) rescheduling is permitted at no charge, subject to availability, provided the request is made at least sixty (60) days before the original event date and the new date falls within twelve (12) months of the original. Subsequent reschedules incur a $250 administrative fee.
4.3 Cancellation by Evergrain
In the rare event we must cancel due to circumstances beyond our control (equipment failure, illness, force majeure), we will issue a full refund of all amounts paid. Our liability is strictly limited to this refund.
5. Venue Requirements
The Client is responsible for ensuring that the event venue provides:
- A minimum floor area of 8 ft × 10 ft for booth setup
- Access to a standard 110V power outlet within 25 feet of setup
- Indoor or covered outdoor space (booth cannot be operated in direct sun or rain)
- Reasonable load-in access (elevator, ramp, or ground-floor entry)
If venue conditions prevent setup as agreed, the Client remains responsible for the full contracted amount.
6. Setup & Teardown
Our team typically arrives ninety (90) minutes before guest arrival and requires approximately forty-five (45) minutes for teardown. Setup and teardown do not count against booked operating hours. Additional idle time (booth on-site but not actively operating) may be quoted at $95/hour.
7. Image Rights & Use
The Client retains personal-use rights to photos captured at the event. Evergrain Photobooth retains a perpetual, royalty-free license to use selected images for marketing, portfolio, social media, advertising, and editorial purposes, unless the Client opts out in writing prior to the event. Guest likenesses captured at the event may also be used; the Client warrants that guests have or will be informed accordingly.
8. Liability
Evergrain Photobooth carries general liability insurance up to $1,000,000. Our total liability to the Client for any claim arising from these Terms or the contracted services is limited to the total amount paid by the Client for the relevant services. We are not liable for indirect, consequential, or punitive damages.
The Client agrees to indemnify and hold Evergrain harmless against claims arising from guest conduct, venue conditions outside our control, or the Client's failure to disclose material event details.
9. Damage to Equipment
The Client is responsible for any damage to Evergrain equipment caused by guests, vendors, or venue conditions, beyond normal wear. Repair or replacement costs will be billed at fair market value within thirty (30) days of the event.
10. Force Majeure
Neither party shall be liable for delays or failures in performance resulting from causes outside reasonable control, including but not limited to natural disasters, government actions, public health emergencies, power outages, equipment failure, or labor disputes. In such cases, the parties will work in good faith to reschedule or substitute services where possible.
11. Intellectual Property
All website content, including logos, copy, photography, and branding, is the property of Evergrain Photobooth and protected by applicable copyright and trademark laws. Reproduction without written permission is prohibited.
12. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.
13. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
14. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. For active bookings, the Terms in effect at the time of contract execution apply.
